면책 동의서와 위험 고지

베이산악회의 모든 산행에 참가하시는 분들과 또 이  산악회 회원으로 가입하시는 분들은 다음의 "산행과 관련된 위험"에  대한  내용을 충분히 잘 인지하고 "면책 동의서"에 동의를 하는 것으로 간주합니다. 아래 내용들을 잘 읽어 보시고 그  내용들을 명확히 잘 인지하시기 바랍니다. 

 

ACKNOWLEDGEMENT OF RISK FOR BACKPACKING, CAMPING, HIKING AND ALL RELATED ACTIVITIES

등산, 백팩킹, 하이킹 등의 활동과 관련된 위험 알림

 

On any camping/day hiking/ backpacking trip and other all activities listed in www.bayalpineclub.net, the risks you may encounter include but are not limited to the following: 

베이 산악회 홈페이지 (www.bayalpineclub.net) 에 등재된 활동, 즉 캠핑/당일산행/백패킹 여행 및 그것에만 국한되지 않은 모든 활동을 통해서 귀하는 위험과 조우할 수 있습니다.

 

1. Accidents can occur while hiking: trails are often steep, rocky, and/or slippery; some hikes involve crossing streams, where footing can be awkward; participants can slip or fall during a hike, resulting in injury or death. Travel by foot is over rugged unpredictable trail and off-trail terrain, including boulder fields, downed timber, river crossings, high mountain passes, snow and ice, steep slopes, and slippery rocks. Attendant risks include collision, falling, drowning and others usually associated with such travel, carpool, as well as environmental risks.

하이킹 활동 중에 사고가 발생할 수 있습니다. 트레일이 험하거나, 돌이 많고 미끄러울 수도 있으며, 냇물을 건널 수도 있고, 발디딤이 부자연스러울 수도 있고, 미끄러지거나 낙상으로 인해서 부상을 당하거나 사망에 이를 수도 있습니다. 보행중에는 험하고 예측불가능한 산길, 반들반들한 암릉 지형, 넘어진 나무, 물을 건너거나, 고산 준령, 눈과 얼음, 가파른 경사면, 미끄러운 바위 등과 같이 길이 없는 지형도 통과해야 합니다.

 

2. Environmental risks include any injury, accidents, or even death coming from rapidly moving, deep or cold water, insects, snakes, and predators, including large animals, poisonous plants; falling and rolling rock, lightning, avalanches, flash floods, any natural disasters, and unpredictable forces of nature, including and weather that may change to extreme conditions without notice.

환경적 요인으로 인한 위험은 급속한 이동, 깊거나 차가운 물, 곤충, 뱀, 맹수 등 야생짐승과의 접촉으로 인하여 입게된 부상이나 사고, 낙석 및 번개, 눈사태, 급작스런 홍수 및 각종 자연재해와 사전에 인지할수 없는 극한의 날씨 변화와 같은 자연 활동 등에 의해 입게된 부상, 사고 내지는 심지어 사망 등을 포괄합니다.

 

3. Meals are prepared over gas stoves and sometimes open fires. Water often requires purification before use. Attendant hazards may include: burns, cuts, and flu-like illness.

산악 활동 시 음식은 종종 가스 스토브와 가끔은 모닥불로 조리됩니다. 물은 사용하기 전에 정수를 해야 할 수도 있습니다. 이 과정에서 사고나 부상 (화상, 상처, 감기 등등)이 발생할 수 있습니다.

 

4. Decisions are made by the leaders and participants in a wilderness setting, based on a variety of perceptions and evaluations which by their nature are imprecise and subject to errors in judgment. Participants may have free and unsupervised time. Throughout the activities, participants are responsible for their own safety and asked to look out for the safety of other members of their group.

산악 활동 시에 산악 리더와 참여자들이 다양한 통찰과 평가에 기초하여 결정을 하게 되는데 이런 결정은 부정확하고 해당 판단은 오류가 있을 수도 있습니다. 이러한 상황에서 참여자들은 자신의 안전에 대해 스스로 책임을 지어야 하는 동시에 그룹내 타인의 안전을 살펴야 합니다.

 

 5. It is also possible that some participants would feel discomfort in uploading/sharing the pictures or suffer mental anguish or trauma from the experience or their injuries.

     산악회 활동에 관련된 사진이나 영상을 산악회 웹싸이트나 카톡 같은 공유 매체로에서 공유하거나 배포 될 수 있습니다. 이 과정에서 불편을 감수해야 할 수도 있습니다. 그리고 부상을 입었을 때 정신적 트라우마나 심리적 고통을 당할 수도 있습니다.

 

 

WAIVER AND RELEASE OF LIABILITY : 면책 동의 

 

IMPORTANT: THIS IS A LEGAL DOCUMENT PLEASE READ THIS DOCUMENT CAREFULLY BEFORE AGREEING IT.

이 면책동의서는 법적 효력을 갖는 문서이기때문에 잘 읽어 보시기 바랍니다.

In consideration of being allowed to participate in any way in the Bay Alpine Club (AKA BAC) programs, related events and activities, I agree to indemnify and hold harmless BAC and their members from all claims, damages, losses, injuries and expenses arising out of or resulting from participation in these activities. I further agree to release, acquit and covenant not to sue BAC and their members for all actions, causes of action, claims or damages, damages in law or remedies in equity of whatever kind, including the negligence of BAC or my family, myself, or my heirs, against BAC arising out of participation in these activities.

베이 산악회와 관련된 일체의 모든 활동과 관련돼서 발생하는 여하한 사고 혹은  부상, 피해 등에 대해서 어떠한 책임도 베이 산악회와 산악회 회원들 그 회원의 가족이나 친지들에게 전가하거나 책임을 묻지 않을 것이고 어떠한 법적으로 소송도 걸지 않을 것에 동의를 합니다.

 

I am aware that ACKNOWLEDGEMENT OF RISK FOR CAMPING/ HIKING/ BACKPACKING AND OTHER RELATED ACTIVITIES entails risks of injury or death to any participant. I understand the description of these inherent risks is not complete and that other unknown or unanticipated inherent risks may result in injury or death. I agree to assume and accept full responsibility for the inherent risks identified herein and those inherent risks not specifically identified including transportation to and from the activities.

산악회 활동과 관련해서 일어날 수 있는 여하한 위험 요소들과 관련하여 <베이산악회 활동과 관련된 위험 시인서>를 잘 읽고 이해했으며 그 문서에 언급되지 않는 예측불가한 어떠한 다른 위험이나 피해가 발생할 수 있음을 인지하면서 이에 대해 여하한 책임도 산악회에 물리지 않을 것에 동의합니다.

 

I authorize and release to Bay Alpine Club (BAC) the use of my image in any photograph or video recording for any purpose of BAC.

베이 산악회 활동 중에 찍힌 본인의 사진이나 영상을 베이 산악회가 여러 목적으로 사용하는 권한을 허락합니다.

I agree to the site of any lawsuit and the law governing any such lawsuit shall be California and governed by California law. The terms of this agreement shall continue and be in effect as long as I participate or involve any or all BAC and its related activities.

산악회에 관련된 여하한 것도 캘리포니아의 법에 따를 것이고 또 이 주 안에서 처리가 될 것이며 여기에 동의한 조건들은 산악회 활동에 참여하는 한 지속될 것임에 동의를 합니다.

 

By putting a check mark on these two items when joining the membership, you acknowledge that you have read and understood and agree to  

"ACKNOWLEDGEMENT OF RISK FOR BACKPACKING, CAMPING, HIKING AND ALL RELATED ACTIVITIES" and  "WAIVER AND RELEASE OF LIABILITY" associated with Bay Alpine Club.

 

* 회원 가입시 이 문서를 읽고  "등산, 백팩킹, 하이킹 등의 활동과 관련된 위험 알림" 과 "면책동의서" 에 (체크 마크를 해서) 동의함으로써, 베이산악회에 가입한 모든 회원은 이 문서에 동의한 것으로 간주하고 이에  베이 산악회는 위험과 사고에 따른 그 어떠한 책임도 지지 않음을 명확히 밝힙니다.
